Colorado House Bill allows for forcible firearm confiscation with no due process and requires accused to "prove" they are worthy to maintain their personal property and right to keep and bear arms. (Click here for more details)

HB19-1177 passed the House Judiciary Committee on February 21st. and will be heard by the full House on February 22nd.  The bill allows family members, ex-spouses, roommates and even former intimate partners to petition the court to issue an "emergency protection order" and forcibly confiscate firearms and any permits to possess them. The initial hearing can be conducted over the telephone without the presence or even the knowledge of the accused and can result in the immediate government confiscation of all firearms owned or in the possession of the accused.  A hearing conducted two weeks after the initial petition requires the accused to prove they deserve to maintain their own property and rights. The accuser need only present the weakest standard of evidence in civil court proceedings to obtain the order.
