Colorado's Unconstitutional End-Run on the Electoral College
Update: This bill was passed by Both the full House and full Senate. It now awaits Governor Polis' signature.
The Colorado State Senate has introduced and obtained passage of a bill that seeks to circumvent the Electoral College laid out in the United States Constitution. The bill, Senate Bill 42 (https://leg.colorado.gov/bills/sb19-042), proposes to award Colorado’s Electoral College votes, not to the winner in the State of Colorado, but to whomever obtains the highest number of national popular votes. That’s right: regardless of who the citizens of Colorado have chosen as president, Colorado’s votes would be routed to the winner of the national popular vote.
This bill appears to cement the shift of our Country’s entire leadership and direction to that sought by large populations centers regardless of Colorado citizens’ wishes. In the 2016 Presidential election, Hillary Clinton received more popular votes than Donald Trump. This popular vote advantage could largely be accounted for in the five counties around New York City. From the NY State Board of Elections, in those five counties (Kings, Bronx, Queens, Richmond and New York counties), Hillary Clinton garnered 2,164,575 votes while Donald Trump garnered 494,549. Clinton’s popular vote advantage was 1,670,026. According to the Federal Election Commission, Clinton’s national popular vote lead was 2,868,691. So, New York City—alone—accounts for nearly 60% of Clinton’s popular vote advantage nationwide. The founders were cautious about mob rule and inserted relief valves into our system to combat the natural tendency toward mob rule. Now, we have members of the Colorado General Assembly quickly pushing this bill through the State Senate, a likely sail through the State House to what will likely be a signature by Governor Polis.
To cede Colorado’s voice to that of mob rule in a few large metropolitan areas in the nation (outside Colorado) is legislative malpractice and fraud and illustrates proponents’ wishes to have Colorado under the collective thumb of a few large metropolitan areas and disregarding millions of Coloradans’ preference.
